Got a notice: ‘GSTR-3B late fee ₹2,000 + interest ₹1,800’? Here’s exactly how GST late fees (₹50/day) and interest (18% p.a.) are calculated in 2026 — with 4 worked examples so you can check the portal math and never overpay.
01 Late Fee Rule in One Table (2026)
Return | Normal fee | Nil fee | Max cap* | Applies per |
GSTR-1 | ₹50/day (₹25 CGST+₹25 SGST) | ₹20/day | ₹10,000 (CBIC caps lower for small turnover) | Day, per return |
GSTR-3B | ₹50/day | ₹20/day | ₹10,000 | Day, per return |
GSTR-9 (annual) | ₹100/day | ₹100/day | — | Day |
* CBIC amnesty lowers caps (e.g., ₹1,000-2,000) for small turnover — check latest circular. Portal auto-applies cap at filing.
02 Interest Rule — 18% p.a. on Net Tax
Interest = 18% per year on net tax payable (cash ledger portion after ITC) × days delayed ÷ 365. Not on total turnover, not on late fee. Nil GSTR-3B = ₹0 interest.
Remember: Formula: Interest = Net Tax × 18% × Days Delay ÷ 365. Example: Tax ₹50,000 delayed 10 days → 50,000×0.18×10/365 = ₹246.58.
